PHIA Expert es un software para análisis de peligros de proceso (HAZOP, HAZID, LOPA y What-If). El acceso se otorga por licencia y por el período contratado.PHIA Expert is software for process hazard analysis (HAZOP, HAZID, LOPA, and What-If). Access is granted by license and for the contracted period.
3.Licencia y uso permitidoLicense and permitted use
Le concedemos una licencia limitada, no exclusiva e intransferible para usar el software conforme al plan contratado. No puede revenderlo, descompilarlo ni usarlo para fines ilícitos.We grant you a limited, non-exclusive, non-transferable license to use the software according to the contracted plan. You may not resell, decompile, or use it for unlawful purposes.
4.Cuentas y accesoAccounts and access
El acceso a la aplicación lo habilitamos nosotros tras la contratación. Usted es responsable de la confidencialidad de sus credenciales y de la actividad realizada con ellas.Access to the application is enabled by us after contracting. You are responsible for the confidentiality of your credentials and for the activity carried out with them.
5.Pagos y período de alquilerPayments and rental period
El servicio se alquila por el período que usted elija; el precio se calcula según el plan y la duración. Los importes se facturan en USD, salvo acuerdo distinto.The service is rented for the period you choose; the price is calculated based on the plan and duration. Amounts are billed in USD unless otherwise agreed.
6.Propiedad intelectualIntellectual property
El software, la marca PHIA Expert y sus contenidos son propiedad de Global Safety Solutions LLC. El contenido de los estudios que usted cargue sigue siendo suyo.The software, the PHIA Expert brand, and its contents are the property of Global Safety Solutions LLC. The content of the studies you upload remains yours.
7.Responsabilidad del usuarioUser responsibilities
El software es una herramienta de apoyo metodológico; las decisiones de seguridad y su validación son responsabilidad del usuario y de su equipo técnico competente.The software is a methodological support tool; safety decisions and their validation are the responsibility of the user and their competent technical team.
8.Limitación de responsabilidadLimitation of liability
El servicio se ofrece "tal cual". En la medida permitida por la ley, no seremos responsables de daños indirectos o de decisiones tomadas con base en los resultados del software.The service is provided "as is." To the extent permitted by law, we shall not be liable for indirect damages or for decisions made based on the software's output.
9.TerminaciónTermination
Podemos suspender o terminar el acceso ante un incumplimiento de estos términos. Al vencer el período contratado, el acceso finaliza salvo renovación.We may suspend or terminate access upon a breach of these terms. When the contracted period ends, access terminates unless renewed.
10.Cambios a los términosChanges to the terms
Podemos actualizar estos términos. La versión vigente se publicará en esta página con su fecha de actualización.We may update these terms. The current version will be published on this page with its update date.
11.Ley aplicableGoverning law
Estos términos se rigen por la legislación aplicable a Global Safety Solutions LLC. Cualquier controversia se resolverá ante los tribunales competentes de dicha jurisdicción.These terms are governed by the law applicable to Global Safety Solutions LLC. Any dispute shall be resolved before the competent courts of that jurisdiction.
